Why these terms?​

 

These are important terms that define agreement between users/customers and coach Mr. Rakaesh K Misra (referred as "coach" in rest of the page for simplicity) for use of the website successlab.co.in as well as for signing up for any services offered by Mr. Rakaesh K Misra or his organisation InnerGpoint (OPC) Private Ltd. (referred as "Organisation" for simplicity), directly from this website or otherwise.

These terms include expectations from user/customer regarding certain commitments as well as understanding that user/customer must have in order to accept engagement with Mr. Rakaesh K Misra. If users/customers don't agree with these terms, they are advised not to engage with Mr. Rakaesh K Misra or avail any services offered on successlab.co.in website or by InnerGpoint (OPC) Private Limited.

Hence, users are encouraged to go through these terms carefully and accept them in entirety willingly in order to register on this website for engaging with Mr. Rakaesh K Misra and his organisation InnerGpoint (OPC) Private Limited.

1. Confidentiality

​

We believe that any form of personal coaching is a private matter for user/customer and hence we are highly sensitive about maintaining full confidentiality for all information being shared by the user/customer as part of our standard professional ethics being followed at successlab.co.in and at InnerGpoint (OPC) Private Limited.

Confidential Information does not include information that: (a) was in the coach’s or Organisation's possession prior to its being furnished by the user/customer; (b) is generally known to the public or in the user’s /customer's industry; (c) is obtained by the coach or by the Organisation from a third party, without breach of any obligation to the user/customer; (d) is independently developed by the coach without use of or reference to the user's/customer's confidential information; or (e) the coach is required by statute, lawfully issued subpoena, or by court order to disclose; (f) is disclosed to the coach and as a result of such disclosure the coach reasonably believes there to be an imminent or likely risk of danger or harm to the user/customer or others; and (g) involves illegal activity. The user/customer also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the coach or the Organisation in a timely manner.

However, user/customer also must be aware that the coach-customer relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognised privilege. The coach agrees not to disclose any information pertaining to the user/customer without the his/her consent. The coach and the Organisation will not disclose the user's/customer's name as a reference without his/her consent.

2. Limited Liability
 

Except as expressly provided in this agreement, Mr. Rakaesh K Misra and his Organisation make no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall Mr. Rakaesh K Misra or his Organisation be liable to the user/customer for any indirect, consequential or special damages. Notwithstanding any damages that the user/customer may incur, Mr. Rakaesh K Misra's and his Organisation's liability under this agreement, and the user's/customer's exclusive remedy, shall be limited to the amount actually paid by the user/customer to Mr. Rakaesh K Misra or his Organisation under this agreement for all coaching services rendered through and including the termination date.

By using any content, product, or service offered on this website, user/customer acknowledges that there are certain risks inherent in any health program or physical exercise and release Mr. Rakaesh K Misra and his Organisation of liability for those risks. Mr. Rakaesh K Misra and his Organisation are not responsible for any mental or physical liability incurred by using any free or paid content, product, or service on this website or any other social media links offered by Mr. Rakaesh K Misra, his Organisation and successlab.co.in website. Mr. Rakaesh K Misra and his Organisation are not responsible for any errors, inaccuracies, or omissions in the website’s content, social media links, articles, reposts, or any personal injury or damage resulting from use of our products, services or suggestions. User/Customer assume all liability. This limitation of liability shall apply to the fullest extent permitted by law.

3. Copyrights

All content, images, graphics, icons, logos, publications, writings, sounds, videos, documents and original concepts contained in this website and shared with user/customer on email or in person are all protected by copyright to the full extent of the law. You may not reproduce, copy, repost, share or circulate any such artefact, content or images from this website or received from Mr. Rakaesh K Misra except with written permission of Mr. Rakaesh K Misra or in ways legally defined as personal or fair use.

4. Terms of Membership Engagement Updates

 

Mr. Rakaesh K Misra and his Organisation reserve the right to modify these terms at any time, so users must review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to these terms, we will notify users /customers here that it has been updated, so that users/customers are aware of these changes.

 

If user/customer has objection to any such changes, he/she must immediately stop using our website and discontinue the engagement with Mr. Rakaesh K Misra and his Organisation. Users/Customer are bound by any changes to these membership terms when engaging with Mr. Rakaesh K Misra after those changes have been updated in this membership terms page.
